Terms of Service

These Terms are the agreement between you and Langulect. They set out what you may do with the app, what we undertake to do, and the limits of our responsibility. Please read them, and pay particular attention to sections 15 and 16, which limit our liability, and to section 18, which governs how disputes are resolved.

If you do not agree to these Terms, do not use Langulect.

1. Agreement to these Terms

By downloading, installing, signing in to or otherwise using Langulect, you agree to these Terms and to our Privacy Policy, which is incorporated into them by reference. Together they form a binding agreement between you and us.

The app asks you to confirm this the first time you sign in, and records the date of that acceptance against your account. If you are agreeing on behalf of someone else, you confirm you are authorised to do so.

2. Definitions

  • “Langulect”, “we”, “us” and “our” mean the developer of the Langulect Android application and the langulect.com website.
  • “Service” means the app, the website, and the servers that support them.
  • “Content” means the courses, exercises, vocabulary, grammar explanations, audio, artwork and text that make up Langulect.
  • “you” means the individual using the Service.

3. Eligibility and age

You must be at least 13 years old to use Langulect, at least 16 if you are in the European Economic Area or the United Kingdom, or older where your country of residence sets a higher age for consenting to online services.

If you are under the age of majority where you live, you confirm that a parent or legal guardian has read and agreed to these Terms on your behalf and accepts responsibility for your use of the Service.

You must not use Langulect if doing so is prohibited by the law of your country, or if you are subject to sanctions that would prohibit us from providing it to you.

4. Your account

Langulect uses Google Sign-In. You are responsible for maintaining the security of the Google account you sign in with, because anyone who can access it can reach your Langulect progress. Tell us at langulect@gmail.com if you believe your account has been accessed without your permission.

You may also use Langulect without an account. In that case your progress is stored only on that device and is not synchronised or backed up. If you uninstall the app or lose the device, that progress is permanently gone and we have no copy to restore. This is a consequence of not creating an account, not a defect.

One person, one account. You must not create accounts in bulk or by automated means, and you must not sell, rent, share or transfer an account to anyone else.

You are responsible for the accuracy of the information associated with your account, and for any activity that takes place through it.

5. Licence to use Langulect

Subject to your compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to install and use the app on devices you own or control, and to access the Content, for your own personal, non-commercial language learning.

That is the entire scope of what is granted. All other rights are reserved. No rights are granted by implication, estoppel or otherwise.

6. Restrictions

You must not, and must not attempt to, and must not permit anyone else to:

  • copy, sell, rent, lease, sublicense, distribute or publicly display the app or the Content;
  • modify, adapt, translate, decompile, disassemble or reverse-engineer the app, except to the limited extent that applicable law expressly permits despite this restriction;
  • remove, obscure or circumvent any security feature, rate limit, or the check that verifies the app was installed from Google Play;
  • extract the Content in bulk — by hand, by script, by scraping our servers or by any automated means — whether to build a competing product, to assemble a dataset, or to train a machine-learning model;
  • use the Service to develop a product or service that competes with Langulect;
  • access the Service other than through the interfaces we provide, including by using an unofficial client or by calling our API directly;
  • use the Service for any unlawful purpose, or in breach of any applicable law.

7. Acceptable use and conduct

When using Langulect you agree not to:

  • interfere with or disrupt the Service, or attempt to access accounts, data or systems that are not yours;
  • probe, scan, load-test or attack our infrastructure, or attempt to defeat rate limits or authentication;
  • falsify progress, HOs, streaks or leaderboard position, whether by modifying the app, tampering with stored data, or forging requests to our API;
  • harass, threaten, defame or abuse another learner, or use a display name or profile picture that is abusive, hateful, sexually explicit, or that impersonates another person;
  • use friend codes or session codes to spam, solicit or harass;
  • use automated means to create accounts or to generate activity;
  • encourage or assist anyone else in doing any of the above.

Your display name and profile picture originate from your Google account and are visible to friends you add. Where they breach these Terms we may hide them, reset them, or suspend the account.

8. Friends, leaderboards and group sessions

Connecting with a friend is mutual by design: you exchange codes, and only then can either of you see the other’s display name, picture and HO total. Nothing further about your account becomes visible, and you may remove a friend at any time.

Group session codes are short-lived and are intended for the person you send them to. Anyone holding a valid code can join that session, so treat a code as you would any invitation link and do not publish it.

We do not moderate private exchanges between friends and we do not host user-generated content beyond the profile details described above. If another learner behaves unacceptably, remove them as a friend and, if it warrants it, report it to langulect@gmail.com.

9. The AI tutor and third-party terms

Langulect’s AI tutor uses Google’s Gemma model, running on your own device. To download it you must accept Google’s Gemma Terms of Use and its Prohibited Use Policy. Those are Google’s terms, not ours; they apply in addition to these Terms, and the model is licensed to you by Google rather than by us.

AI output can be wrong. Explanations, corrections, translations and pronunciation feedback are generated automatically and may be inaccurate, incomplete, outdated or occasionally nonsensical. Treat them as a study aid and not as authority. Do not rely on the Service for any translation where accuracy carries legal, medical, financial, immigration or safety consequences.

The model download is several gigabytes. It is restricted to Wi-Fi, but you remain responsible for any data charges your connection incurs and for the storage it occupies. You may delete it from Settings at any time.

We do not warrant that AI features will be available on every device. Older or lower-memory phones may be unable to run the model, in which case the app falls back to its built-in offline tutor and the rest of the Service continues to work.

Langulect also depends on other services we do not control, and their terms govern your use of them: Google Play for distribution, Google Sign-In for authentication, Google Play Services for QR scanning and integrity checks, and your device’s built-in speech recognition and text-to-speech. If one of those changes or is withdrawn, the parts of Langulect that rely on it may stop working.

10. Educational nature and no guarantee of results

Course levels are aligned to the Common European Framework of Reference (CEFR) as a description of the material, not as a certification of your ability. Langulect is not an accredited educational institution, our levels are not qualifications, and completing a course is not evidence of proficiency to any employer, university, examination board or immigration authority.

Language learning depends on the effort you put in. We make no promise that you will reach any particular level, in any particular time, or at all.

11. Changes, updates and availability

We develop Langulect continuously and may add, change, suspend or remove features at any time. Course content is updated over the air, which means the lessons on your device can change without a new app release, including corrections to words and examples.

We may suspend the Service temporarily for maintenance, and may impose reasonable limits on use of our servers to protect the Service for everyone.

Langulect is currently provided free of charge. We do not guarantee that it will always be free or always available. If we introduce paid features, we will say so clearly before you are asked to pay anything, and paying will always be optional at the point of purchase.

12. Intellectual property

The app, the Langulect name and logo, Professor Ray, the course structure, the exercise designs, and the vocabulary and grammar Content we have written are owned by us or licensed to us, and are protected by copyright, trade mark and other laws. These Terms grant you a licence to use the Service, and transfer no ownership.

Third-party names referred to in the app or on this site, including Google, Google Play and Gemma, are the property of their respective owners and are used for identification only. Their use does not imply endorsement.

If you believe material in Langulect infringes your copyright, email langulect@gmail.com with enough detail to identify the work, the material complained of, your contact details, and a statement that you have a good-faith belief the use is unauthorised. We will investigate and remove infringing material where the complaint is substantiated.

13. Feedback

If you send us suggestions, bug reports or ideas, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them without restriction or obligation to you. We will not treat feedback as confidential. This is not us claiming your work: it protects us from a claim that a feature we were already building was yours.

14. Privacy

Our Privacy Policy explains what we collect and why, and forms part of these Terms. In summary: we collect the minimum needed to run the Service, we do not sell your personal information, the app contains no advertising or third-party analytics, and you can delete your account and all of its data from within the app.

15. Term, suspension and termination

You may end this agreement at any time. Delete your account from Settings → Account → Delete account, then uninstall the app. Deletion is immediate and permanent, and is described in section 11 of the Privacy Policy.

We may suspend or terminate your access if you breach these Terms, if your use puts the Service or other learners at risk, if we are required to by law, or if we discontinue the Service. Where the circumstances reasonably allow, we will give you notice, and except for serious or repeated breaches we will give you an opportunity to put matters right first.

If we terminate your account for breach, we may refuse to provide the Service to you again. On termination your licence under section 5 ends immediately. Sections 12, 13, 16, 17, 18 and 20 survive termination.

16. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy of content, and non-infringement.

We do not warrant that:

  • the Service will be uninterrupted, timely, or free of errors or defects;
  • the Content or AI output will be accurate, complete or suitable for your purposes;
  • your progress will always synchronise successfully, or that data will never be lost;
  • the Service will be secure against every possible attack.

Keep your own record of anything you cannot afford to lose. We take care with your data and back up our servers daily, but you should not treat Langulect as the sole record of anything important to you.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here excludes liability that cannot lawfully be excluded, and if you are a consumer your statutory rights are unaffected.

17. Limitation of liability

To the fullest extent permitted by law, Langulect will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for any loss of data, loss of learning progress, loss of profits, loss of goodwill or loss of opportunity, arising out of or relating to your use of or inability to use the Service, however caused and on any theory of liability.

Where liability cannot be excluded, our total aggregate liability for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or twenty US dollars (US$20). Langulect is currently free, so for most users this is the latter.

These limits apply even if we have been advised of the possibility of the loss, and even if a limited remedy fails of its essential purpose.

Nothing in this section limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that applicable law does not permit to be limited. If you are a consumer, your statutory rights are unaffected.

18. Governing law and disputes

These Terms and any dispute arising out of them or the Service are governed by the laws of England and Wales, without regard to conflict-of-law rules, and the courts of England and Wales have exclusive jurisdiction, subject to the paragraph below.

If you are a consumer resident in the European Economic Area or the United Kingdom, nothing in this section deprives you of the protection of the mandatory consumer law of your country of residence, or of your right to bring proceedings in the courts of that country.

Please talk to us first. Before commencing formal proceedings, email langulect@gmail.com describing the problem and what you would like us to do, and allow us thirty days to respond. Most complaints turn out to be bugs, and bugs are far cheaper to fix than to litigate.

19. Changes to these Terms

We may update these Terms as the Service develops or as the law requires. The date at the top changes when we do, and the updated version takes effect on the effective date shown.

If a change is material, the app will ask you to review and accept the updated Terms rather than relying on you noticing a new date on a web page. Continuing to use Langulect after a change takes effect means you accept it. If you do not accept an update, you should stop using the Service and may delete your account.

20. General provisions

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service, and supersede any prior understanding.
  • Severability. If any provision is held unenforceable, it is severed or limited to the minimum extent necessary and the remainder stays in force.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign or transfer these Terms. We may assign them in connection with a merger, acquisition or sale of the Service, on notice to you.
  • Notices. We may give notice through the app, on this site, or by email to the address associated with your account. You should give notice to us by email.
  • Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control.
  • No agency. These Terms create no partnership, agency or employment relationship between us.
  • Headings. Section headings are for convenience and do not affect interpretation.
